Acknowledgment And Acceptance Of Terms Of Service

These General Terms of Service (“Service Terms”) are provided by GEEKS Technology DMCC (“GEEKS”) to you (“Customer”) in connection with the services that you have purchased (“Service”). These Service Terms constitute the entire agreement between the Customer and GEEKS regarding the Service. By using our Service, you confirm that you are at least 18 years old or have obtained the consent of a legal guardian.

Payment

Unless otherwise agreed in writing, all fees and charges are non-refundable. GEEKS may revise pricing or introduce new charges based on market conditions. All prices are in AED and exclusive of VAT, in accordance with UAE tax regulations.

Modifications to terms of service and service

GEEKS reserves the right to update these Service Terms or modify/discontinue the Service at any time. Any such updates will be posted on the website from which the Service was purchased. Continued use of the Service after changes are posted constitutes your acceptance of those changes. It is your responsibility to review the Terms periodically.

Customer’s responsibility to back-up data

Prior to any servicing, the Customer is responsible for backing up all data from their devices and removing any physical media. GEEKS and its service providers shall not be liable for any loss, alteration, or corruption of data, software, or media regardless of whether backup services were requested.

Device Storage

Devices left unclaimed for over 60 days after evaluation or repair completion may be responsibly recycled, donated, or discarded. GEEKS will attempt to contact the Customer via phone, SMS, or email. If these attempts fail, GEEKS will not be held liable for the unclaimed device after the stipulated 60-day period. By using our service, the Customer agrees to this policy and forfeits the right to claim the device or seek damages after the stated period.

Limitations to service

Geeks shall not be liable for any failure or delay in performance due to any cause beyond its control. GEEKS and/or its third party service providers reserve the right to refrain from providing the Services ordered and instead refund Customer’s payment, wholly or in part, on the basis that the minimum system requirements are not met or the technical needs (including wiring or overcoming physical or technical barriers) or other requirements of the Customer are unusual or extensive and beyond the scope of these Service Terms, as determined by GEEKS.

Indemnification

Customer agrees to indemnify, defend, and hold harmless Geeks (and its affiliates and their respective officers, directors, employees and agents) from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by GEEKS by reason of, or arising from:

(a) Customer’s breach of this Agreement;

(b) Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person;

(c) Customer’s actual or alleged failure to promptly pay sums due GEEKS or third parties;

(d) Customer’s failure to comply with applicable laws, regulations or ordinances; or

(e) the acts or omissions of Customer (or its officers, directors, employees or agents).

Warranty

GEEKS offers warranties on parts/services according to the following categories:

  • Category A: 2 years
  • Category B: 6 months
  • Category C: 3 months
  • Category D: Manufacturer’s warranty

 

Warranty is limited to the parts and/or service(s) that were paid for by the customer.
After Geeks repairs the device, the warranty does not protect against:
Mishandling that causes the part to bend, twist, or crack
Water damage
Subsequent accidental or purposeful drops
Damage resulting from attempted customer repairs
Software issues unrelated to the repair
New damages unrelated to the original repair
Any loss of data occurring as a result of the repair – customers are advised to back up all data prior to repair attempt.

Our warranty also does not cover the outcome of a repair if certain pre-repair conditions exist, including:
Existence of known manufacturing and/or performance issues related to the device, separate from the repair
Existence of damage to the frame of device, as noted prior to the repair
Jailbroken devices
Tampering with internal hardware: under certain conditions, internal damage may make a repair impossible.

Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. GEEKS disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. GEEKS does not guarantee uninterrupted, error-free service or accuracy of information. Use of the Service is at the Customer’s sole risk.

Termination

Either party may terminate the Service by written notice. Upon termination, the Customer’s access to the Service ends immediately. Any prepaid amounts are non-refundable unless explicitly agreed otherwise. GEEKS will have no further obligations post-termination.

Laws

These Terms shall be governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai. Both parties agree to submit to the exclusive jurisdiction of Dubai courts. Any legal claims must be initiated within one (1) year from the date the cause of action arises.
